NEW YORK A judge yesterday dismissed attempted murder and assault charges against subway gunman Bernhard Hugo Goetz, but said the controversial case should be submitted to a third grand jury.
State Supreme Court Judge Stephen Crane dropped the charges on the ground that Assistant Manhattan District Attorney Gregory L. Waples had failed to tell the grand jury that Goetz could plead self-defense if he "reasonably believed unlawful physical force was about to be used against him."
