Adam Smith is unfair to Fairtrade

Contrary to the Adam Smith Institute's analysis of Fairtrade, producers receive 100 per cent of the social premium, which is agreed at point of sale between the producer and the buyer, not by the supermarkets. Is the institute unaware that such price-fixing at the retail stage is illegal?
