Nullification

I had thought that the horrible 2016 election cycle was over, but three woman have filed a federal court action that could result in the 2016 presidential election being tossed out. I am sure that the text of their action is available online somewhere, but I don’t know where. From what I managed to find out, this suit is in regard to Russian actions to affect the election, and their claim is under the Guarantee Clause of the Constitution.

"Allegations are that the U.S. government knew that hackers from Russia had successfully attacked and penetrated the election databases of at least 12 states and did not protect our democracy as required. It was further reported that Russia successfully penetrated both the Democratic and Republican parties but only leaked material damaging to Hillary Clinton and her campaign."

The Guarantee Clause requires: The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened), against domestic Violence.

The case went before a Supreme Court conference a few days ago, but there is no news, yet, as to whether the Court will hear the case. If four justices vote to hear it, then the full court will hear the case.
The information about the Russians cracking computers of the DNC and some states have been around since before Election Day, and there appears to be quite a lot of evidence that it really happened. Some of the nasty comments about Hillary were based on stolen emails. I don't know much about state computers having been cracked, but I remember it having been discovered a few months ago. I believe that some of the computer work was traced to people in Russia, but I don't know who they were or whether they are employed by the Russian government. certain whether it makes any difference to this case whether they were employed by a foreign government or if they were simply messing with voting records, tallies, etc. for entertainment in any case they would have compromised the validity of the election, and that might be enough to toss out the results.

It does appear that the election was compromised, so the results probably should be voided. Unfortunately, that will leave the U.S.A. without leadership for an indefinite amount of time, in addition to voiding all actions done by Trump.

I do not believe that there are procedures for this situation, nor am I sure how much would be voided. I have gotten the impression that the complete election at all levels would be voided, including state and local offices along with the pres., senators, and House members. This would create a tense situation. Trump supporters might try to impede the process, but I believe that the federal police agencies would strive to ensure the process would be completed. The first few minutes until a Secret Service agent said, "No, we can't, because are not the president," would be very tense, but I have faith that there are suitable people in the right places.

I don't know where this would lead, or even whether the Supreme Court will hear it, but we will find out in the near future. People like Trump and the Russians have to learn that we, the people of these United States own this country, not any crowd of fat cats, so don't mess with us.

This will almost certainly result in the end of the two party system as we know it, but I don't what the political system will be like a few years later, if the Supreme Court does nullify the election. I don't think that either Trump or Clinton will win in the redo, but I wouldn't put money on that.

We will just have to wait and see.
